The rules that govern your use of the Adaptrials platform.

1. Scope and Provider
These Terms govern access to and use of the Adaptrials adaptive-design platform, operated by Aomics GmbH, Wiesbadener Str. 120, 61462 Koenigstein im Taunus, Germany. The Adaptrials platform is a part of Aomics GmbH. By registering an account or using the platform you accept these terms.
2. Registration and Accounts
Access requires a registered account. New registrations become active after review and approval by an administrator. You are responsible for the confidentiality of your credentials and for all activity under your account. You must use your real identity and inform us promptly of any suspected unauthorised access.
3. Permitted Use
Use exclusively for planning, simulation and documentation of clinical trial designs. You agree not to: (a) use unlawfully; (b) attempt unauthorised access to accounts, studies or systems; (c) upload malicious code; (d) reverse-engineer except where permitted by law; or (e) remove audit-trail or attribution information. Role-based permissions — including separation of authorship and approval — are core to the governance model and must not be circumvented.
4. Demonstration Data
Unless agreed otherwise in writing, all studies shown here contain synthetic demonstration data — no patient data — and must not be used for regulatory submissions. Outputs from your own uploaded data remain your responsibility; Adaptrials provides statistical tooling, not medical or regulatory advice.
5. Intellectual Property
The platform, software and documentation are protected by copyright and other industrial property rights of Aomics GmbH. You retain all rights to design content, data and documents you create or upload. You grant us a limited, non-exclusive licence to store and process such content solely to operate the platform for you.
6. Availability and Changes
Provided "as is". We continuously develop features and may modify or discontinue individual functions, provided this is reasonable for you. Scheduled maintenance is announced where possible. Statutory warranty rights remain unaffected.
7. Liability
Aomics GmbH is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In case of slight negligence, liability exists only for breach of a material contractual obligation (cardinal duty), limited to the damage typical for this type of contract; otherwise liability is excluded. The same applies to legal representatives and vicarious agents.
8. Term and Termination
The usage relationship lasts indefinitely and may be terminated by either party at any time. Upon termination your account is deactivated; statutory retention duties — including audit-trail integrity for completed study workspaces — remain unaffected.
9. Data Protection
How we process your personal data is in our Imprint and Data Protection notices.
10. Governing Law and Jurisdiction
German law applies, excluding the UN CISG. The place of jurisdiction where permitted by law is Frankfurt am Main. Should individual provisions be invalid, the remainder stays effective; the invalid provision is replaced by the closest permissible one.
